PLEASE READ THESE TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THE WEB SITE OR PURCHASING ADVERTISING. By using this Web site and/or purchasing advertising, you (“You” or “Advertiser”) signify Your assent to these terms of use. If You do not agree to these terms of use, please do not use the site. We reserve the right, at our discretion, to change, modify, add, or remove portions of these terms at any time. Please check these terms periodically for changes. Your continued use of the Web site following the posting of changes to these terms will mean You accept those changes.

DUTIES OF NEWSQUEST SPECIALIST MEDIA guarantees that all advertisements loaded and paid for using these services will go live on the site as soon as commercially practicable. Should the advertisement not appear on the site for the full time period agreed to by the parties, a pro-rata refund will be given for the days the advertisement did not appear. NEWSQUEST SPECIALIST MEDIA do not guarantee any level of response, or that any particular advertisement will reach any specific audience.

DUTIES OF THE ADVERTISER

You agree that we may, at our discretion and without liability to You, remove any advertisement which is posted that in our judgment is in breach of these rules.

Job advertisements must be for genuine vacancies only, and not for other products or services, either relating to or unrelated to recruitment including, but not limited to, affiliate schemes, pyramid selling schemes or any other so called 'business opportunity'.

All information contained in postings must be clear complete and accurate, not false or misleading in any way, containing sufficient detail. Postings which require the user to "email for more details" are not permitted.

Advertiser may not post multiple listings for the same job.

No gratuitous use of keywords in job descriptions or job titles. Gratuitous means deliberately inserting words, strings of words, or repeating job titles, with the intention of influencing position in the results listing, or increasing the number of page views. Jobs that infringe this rule will automatically go into 'pending' mode and will not go live on the site until repeated keywords are removed.

URLs are not permitted in the body copy of the job description page.

We cannot monitor every posting to the Web site, nor do we take responsibility for the content posted by our users. However, we do randomly monitor postings to ensure compliance with these House Rules.

NEWSQUEST SPECIALIST MEDIA do not tolerate unsolicited commercial email. Web site users involved in such activity will have their accounts suspended.

No endorsements by NEWSQUEST SPECIALIST MEDIA or warranty with respect to any user or third party, whether in regards to its Web site, products, services, hiring, experience, employment or recruiting practices, or otherwise.

By uploading materials to any website or submitting any materials to us, You automatically grant (or warrant that the owner of such rights has expressly granted) us a perpetual, royalty-free, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from and distribute such materials or incorporate such materials into any form, medium, or technology now known or later developed throughout the universe. In addition, You warrant that all so-called "moral rights" in those materials have been waived.

No guarantee of Results. NEWSQUEST SPECIALIST MEDIA is not an employment agency or a recruiting firm, and makes no representations or guarantees regarding the effectiveness or timeliness of the Site in meeting the employment objectives of Users. NEWSQUEST SPECIALIST MEDIA does not guarantee that documents posted by users will result in candidates being hired or positions being filled, and is not responsible for any employment decisions, for whatever reason made, made by any User.

You agree that NEWSQUEST SPECIALIST MEDIA may modify the text and or categorization of any advertisement submitted in the interest of clarity or completeness.

Use of any robot, spider, other automatic device, or manual process to monitor or copy our Web pages or the Content is strictly forbidden.

USAGE BY CHILDREN UNDER 13. The Web site is directed to adults and is not directed to children under the age of 13. NEWSQUEST SPECIALIST MEDIA cannot prohibit minors from visiting the Web site. NEWSQUEST SPECIALIST MEDIA must rely on parents, guardians and those responsible for supervising children under 13 to decide which materials are appropriate for such children to view and/or purchase. NEWSQUEST SPECIALIST MEDIA complies with the Children's Online Privacy Protection Act and does not permit registration by and will not knowingly collect personally identifiable information from anyone under 13. This requirement will be posted wherever NEWSQUEST SPECIALIST MEDIA collects data within the Web site, such as during the registration process.

MEMBER ACCOUNT. If You register as a user of this Web site, You will be assigned a username and password that is unique to You. You are responsible for maintaining the confidentiality of the username and password, and responsible for all activities that occur under Your username and password. You agree to notify NEWSQUEST SPECIALIST MEDIA of any unauthorized use of Your username and password or any other breach of security.

FEES AND PAYMENTS. Signing this Agreement obligates Advertiser to a Fifty Percent (50%) non-refundable deposit, due with this signed Agreement. The balance must be paid within thirty (30) days of the Advertisement appearing on the site. NEWSQUEST SPECIALIST MEDIA reserves the right at any time to charge fees for access to portions of the Web site or the Web site as a whole. You authorize NEWSQUEST SPECIALIST MEDIA to charge to the credit card account designated during the registration process the current fees and charges for each term according to the subscription plan, premium content or other product or service chosen by You. You agree to pay all fees and charges incurred through Your account at the rates in effect for the billing period in which such fees and charges are incurred. You agree to pay all applicable taxes relating to use of the Web site through Your account. All payments are to be made in British Pounds Sterling or any alternative currency that NEWSQUEST SPECIALIST MEDIA may specify. If NEWSQUEST SPECIALIST MEDIA does not receive payment authorisation from Your credit card clearing service, NEWSQUEST SPECIALIST MEDIA may immediately suspend or terminate Your use of the site. You are responsible for the payment of all charges associated with the use of the Site using Your ID. You are also responsible for any charges associated to connecting to the NEWSQUEST SPECIALIST MEDIA sites, including but not limited to, any telephone line charges or any Internet access provider charges. You shall provide NEWSQUEST SPECIALIST MEDIA with accurate, complete and updated information as to Your name and e-mail address and credit card account information provided by You at registration. Failure to do so shall constitute a breach of this Agreement.

INDEMNIFICATION. You agree to indemnify, defend and hold NEWSQUEST SPECIALIST MEDIA harmless from any liability, loss, claim and expense, including reasonable attorneys fees, related to Your violation or alleged violation of these Terms of Use or use of the Web site.

ILLEGAL ADVERTISEMENTS. Advertisements which appear to discriminate on grounds of sex, race or disability are illegal and may result in proceedings being taken against both the advertiser and the publisher. If we believe that an advertisement may be discriminatory we may at our discretion either amend the advertisement or remove it from the job sites we operate without liability to You to make any refund of amounts paid or due to be paid in respect of the posting or otherwise and will inform You accordingly.
The Advertiser further warrants that the advertisement does not contravene any Act of Parliament nor is it in any other way illegal or defamatory or an infringement of any other party’s rights or an infringement of the British Code of Advertising Practice. Country of origin (other than the United Kingdom) of goods advertised must be shown in advertisements if so required by stature of statuary or other regulations.

AMENDMENT & CANCELLATION. The Advertiser must submit written notice of cancellation to NEWSQUEST SPECIALIST MEDIA any Advertisement(s) at least 5 Working Days prior to the publication of the Advertisement(s). Advertisers cancelling 5 working days or more will receive a refund of any unused, prepaid amounts above the 50% non-refundable deposit. Advertisers cancelling less than 5 working days prior to publication shall be responsible for 100% (one hundred percent) of the fee for the Advertising agreed to.

Requests to change the publication date or a request for transfer of such Advertisement(s) to a different Advertising Window will be honored in NEWSQUEST SPECIALIST MEDIA’s sole discretion. If granted, Deposits and pre-payments will be credited towards alternate Advertising Windows.

These provisions are for liquidated damages, not a penalty, and have been incorporated into these Terms and Conditions as a valid pre-estimate of damages. The date of cancellation shall be the date that Management receives Exhibitor’s notice.

NEWSQUEST SPECIALIST MEDIA reserves the right to charge in full for any additional services provided by NEWSQUEST SPECIALIST MEDIA Recruitment, notwithstanding cancellation or transfer of the Advertisement(s).

The Advertiser acknowledges that the cancellation of any Advertisement(s) which forms part of a series of Advertisements will affect any discount rate applicable for that series. NEWSQUEST SPECIALIST MEDIA reserves the right to charge an additional fee for the publishing of the remaining Advertisements in the series or for Advertisements which have already been published at the time of the cancellation.

All invoices of NEWSQUEST SPECIALIST MEDIA shall be paid by the client within thirty (30) days of the date of invoice. In the event of late payment, NEWSQUEST SPECIALIST MEDIA may charge interest on the amount outstanding before and after judgment at the rate of four (4) percent above the Base Rate of National Westminster Bank in force from time to time from the due date until the date of payment.

DISCLAIMER. THE CONTENT IN THE WEB SITE IS PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, NEWSQUEST SPECIALIST MEDIA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. NEWSQUEST SPECIALIST MEDIA DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE CONTENT WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE WEB SITE OR THE SERVER(S) THAT MAKES THE WEB SITE AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. NEWSQUEST SPECIALIST MEDIA DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE CONTENT ON THE WEB SITE IN TERMS OF ITS CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE. YOU (AND NOT NEWSQUEST SPECIALIST MEDIA) ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION. APPLICABLE LAW MAY NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.

LIMITATION OF LIABILITY. UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL NEWSQUEST SPECIALIST MEDIA BE LIABLE FOR ANY SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, THE CONTENT ON THE WEB SITE, EVEN IF NEWSQUEST SPECIALIST MEDIA OR AN NEWSQUEST SPECIALIST MEDIA AUTHORIZED REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. IN NO EVENT SHALL NEWSQUEST SPECIALIST MEDIA'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT (INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE), OR OTHERWISE) EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE WEB SITE.

OTHER. These terms shall be governed by and construed in accordance with the laws of England. You agree that any action at law or in equity arising out of or relating to these terms shall be filed only in the courts located in London, England and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action. If any provision of these terms shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these terms and shall not affect the validity and enforceability of any remaining provisions. You agree that regardless of any law or statute to the contrary, any claim or cause of action arising out of or relating to the Web site and these Terms of Service must be filed within one (1) year of the date the cause of action arose, or be barred as untimely. This is the entire agreement between us relating to the subject matter herein and shall not be modified except as provided herein or in writing, signed by NEWSQUEST SPECIALIST MEDIA. To the extent that anything in or associated with the Web site is in conflict or inconsistent with this Agreement, this Agreement shall take precedence. NEWSQUEST SPECIALIST MEDIA’s failure to enforce any provision of this Agreement shall not be deemed a waiver of such provision nor of the right to enforce such provision.
